Petitioner has placed reliance upon a judgment of this Court dated 22.2.2023 in Rajeev Bansal Vs. Union of India and others, Writ Tax No. 1086 of 2022.

Sri Gaurav Mahajan for the department and Sri Gopal Verma, learned counsel for the Union of India point out that this judgment has been challenged in Special Leave to Appeal (C) No. 6706 of 2023 before the Supreme Court, wherein the judgment of the High Court has been stayed.

List after disposal of Special Leave to Appeal (C) No. 6706 of 2023.

We also provide that any proceeding initiated by the department in the meantime shall remain subject to the outcome of the appeal pending before the Supreme Court.
