The petitioner who has been appointed as officiating Principal of the institution and whose signature has come to be attested on 29th July, 2022 by the District Inspector of Schools and has been functioning as such but he is not being paid salary on the post of officiating Principal of the institution.
Learned counsel for the petitioner submits that non action on the part of the District Inspector of Schools in not asking Committee of Management to take appropriate action and to ensure payment of salary to the post of officiating principal of the institution is in the teeth of the Full Bench judgment of this Court in the case of Dr. Jai Prakash Narayan Singh v. State of U.P. and others: 2014(8) ADJ 617 (FB).
The District Inspector of Schools, Lalitpur is directed to take positive action in this regard within a period of 15 days from the date of production of certified copy of this order and then to ensure that if there is no legal impediment the petitioner is paid salary of the post of officiating principal of the institution continuously month to month and arrears of salary shall also be paid within next two months' time.
With the aforesaid observations and directions, the writ petition stands disposed of.
