Heard learned counsel for the parties and perused the judgment and order impugned.

This appeal, at the behest of Oriental Insurance Co. Ltd., challenges the judgment and award dated 14.3.1996 passed by Motor Accident Claims Tribunal/XIII Additional District & Sessions Judge, Ghaziabad in M.A.C. No. 308 of 1995 whereby the Tribunal has awarded compensation of Rs. 1,26,630/- with interest at the rate of 12%.

The main ground of challenge is the quantum of compensation awarded. The issues raised are now not survived in view of the decision of the Apex Court in National Insurance Co. Ltd. Vs. Pranay Sethi and others, 2017 LawSuit (SC) 1093.

Even on the smallness of amount, this appeal requires to be dismissed.

Hence, this appeal is dismissed.
