HIGH COURT OF JUDICATURE AT ALLAHABAD ?Court No. - 3 Case :- FIRST APPEAL No. - 611 of 2022 Appellant :- Abhishek Kumar Agarwal Respondent :- Ekta Sharma Counsel for Appellant :- Dheeraj Kumar Singh Hon'ble Surya Prakash Kesarwani,J.
Hon'ble Rajendra Kumar-IV,J.
Heard learned counsel for the defendant - appellant.
This appeal under Section 19 of the Family Courts Act, 1984 has been filed by the defendant - appellant praying to set aside the judgment and order dated 29.07.2022 in Misc. Application No.84 of 2021 (Ekta Sharma Vs. Abhishek Kumar Agarwal) under Section 24 of the Hindu Marriage Act, 1955, passed by the Principal Judge, Family Court, Muzaffar Nagar, whereby the court below has directed the defendant-appellant to pay a sum of Rs.3000/- per month to the applicant - respondent towards maintenance and Rs.5000/- in lump sum for litigation expenses.
We have perused the impugned judgment and order dated 29.07.2022 and we find that the court below has well considered the factual and legal aspects of the matter pertaining to the interim maintenance and has lawfully granted the interim maintenance as aforesaid. The appeal is wholly frivolous and, therefore, deserves to be dismissed at the admission stage.
For the reasons aforestated, the appeal is dismissed.
