Learned counsel for the applicant after arguing for sometime on instructions submits that he is not pressing the prayers made in this application for quashing the entire criminal proceedings of Case Crime No.245 of 2015 related to charge-sheet dated 28.9.2015 and cognizance order dated 30.8.2016 arising out of criminal Case Crime No.4631 of 2016, (State Vs. Suryanarayan and others) under Sections 308, 323, 504 and 506 I.P.C., Police Station-Chowk, district-Maharajganj pending in the Court of learned Judicial Magistrate, Maharajganj and prayed that the applicant is desirous to appear before the trial court within a period of two weeks, file bail application and in case the bail application is filed, the same may be decided expeditiously in view of the judgment of Supreme Court in Satender Kumar Antil vs. Central Bureau of Investigation and another, (2021) 10 SCC 773.

In view of the above, prayers made in this application are rejected.

Application is disposed of with the direction that in the event applicant honours his undertaking and files appropriate bail application, Trial Court will undertake all endeavour to decide the same expeditiously in accordance with law considering the judgment passed by Supreme Court in Satender Kumar Antil vs. Central Bureau of Investigation and another, (2021) 10 SCC 773.
