Learned counsel for the applicant after arguing for sometime on instructions submits that he is not pressing the prayers made in this application for quashing the entire criminal proceedings of Criminal Case No.121814/2022 (State Vs. Abhinav Kumar Padey) as well as summoning order dated 18.4.2022 passed by A.C.J.M. Court No.2, District-Varanasi and Charge-sheet dated 18.4.2022 as well as cognizance order dated 18.4.2022 passed by A.C.J.M. Court No.2, District-Varanasi arising out of Case Crime No.18/2022 under Section 419, 420, 504, 506 and 406 I.P.C., Police Station-Kotwali, district-Commissionrate Varanasi, pending before the court of A.C.J.M.-II Varanasi and prayed that the applicant is desirous to appear before the trial court within a period of two weeks, file bail application and in case the bail application is filed, the same may be decided expeditiously in view of the judgment of Supreme Court in Satender Kumar Antil vs. Central Bureau of Investigation and another, (2021) 10 SCC 773.

In view of the above, prayers made in this application are rejected.

Application is disposed of with the direction that in the event applicant honours his undertaking and files appropriate bail application, Trial Court will undertake all endeavour to decide the same expeditiously in accordance with law considering the judgment passed by Supreme Court in Satender Kumar Antil vs. Central Bureau of Investigation and another, (2021) 10 SCC 773.
