Heard the counsel for the parties.

In pursuance to the previous order passed by this Court, the Registrars of Dr. Bheemrao Ambedkar University, Agra and Pt. Deen Dayal Upadhyay University, Gorakhpur are present before this Court.

The present writ petition has been filed praying for a mandamus commanding the respondent - University, i.e., Dr. Bheemrao Ambedkar University, Agra to declare the result of the petitioner of Bachelor of Education for the academic session 2013-14.

It has come on record and it is the admitted case of the University that the petitioner had taken admission before 16th September, 2013 and was, therefore, entitled for declaration of his results in light of the judgment of the Supreme Court in College of Professional Education Vs. State of U.P. and others reported in 2013 (2) SCC 721 and the Full Bench judgment of this Court reported in Km. Rinki Vs. State of U.P. and others (Misc. Single No. 35387 of 2018).

In pursuance to the previous orders passed by this Court, Ms. Shambhavi Tiwari, the counsel for Dr. Bheemrao Ambedkar University has sought instructions and has informed the Court that the results of the petitioner have been declared and the mark-sheet shall be sent on the address given in the admission form and the application of the petitioner.

It has been stated that the mark-sheet of the petitioner has already been prepared and the University seeks two weeks' time to issue the degree to the petitioner. The photo copy of the mark-sheet of the petitioner has also been handed over to the Court which is taken on record.

In light of the aforesaid statement of the counsel for the University, it would serve no useful purpose to keep the writ petition pending.

The writ petition is disposed of with a direction to the Registrar, Dr. Bheemrao Ambedkar University, Agra that the mark-sheet of the petitioner shall be dispatched on the appropriate address of the petitioner within one week from today and the degree of the petitioner for Bachelor of Education 2013-14 shall also be dispatched to the petitioner on the appropriate address within three weeks from today.

It is clarified that in case, the petitioner does not receive his mark-sheet and degree within one month from today, the petitioner shall be at liberty to file a recall application for recall of the present order.
