Matter taken up in the revised list. No one appears on behalf of the appellant to press this appeal. Sri Sanjay Kumar Singh, learned counsel for the State is present.

The present appeal under Section 374 (2) Cr.P.C has been preferred by the appellant against the judgment and order dated 9.10.2002 passed by Addl. Sessions Judge, Court No.10, Budaun in S.T> No.470 of 1997 (State Vs. Sita Ram).

As per the office report dated 22.10.2022, a report of C.J.M., Budaun dated 26.8.2022 has been received stating therein that the sole appellant Sita Ram has died. The said report has been sent after due verification.

This Court has perused the said report which states that the accused-appellant Sita Ram has died.

In view of the above, the appeal stands abated.

File consigned to records.

Office to communicate this order to the District and Sessions Judge, concerned within two weeks.
