Matter taken up in the revised list. No one appears on behalf of the appellant to press this appeal. Sri Sanjay Kumar Singh, learned counsel for the State is present.

The present appeal under Section 374 (2) Cr.P.C has been preferred by the appellant against the judgment and order dated 13.5.2002 passed by Special Judge, N.D.P.S. Act, Etah in S.T. No.1077 of 1996 (State Vs. Shyamvir and another).

As per the office report dated 19.10.2022, a report of C.J.M., Etah dated 16.7.2022 has been received stating therein that the sole appellant Shyamvir Singh has died around 10 years back. The said report has been sent after due inquiry.

This Court has perused the said report which states that the accused-appellant Shyamvir Singh has died around 10 years back.

In view of the above, the appeal stands abated.

File consigned to records.

Office to communicate this order to the District and Sessions Judge, concerned within two weeks.
