In light of the judgments of the Supreme Court reported in Kunhayammed and others versus State of Kerala and others AIR 2000 SC 2587 and Khoday Distilleries Ltd., and others versus Sri Mahadeshwara Sahakara Sakkare Karkhane Ltd., (2019) 4 SCC 376, the review application was heard on merits.

It has been held in the judgment under review that the orders passed by the mutation authorities were not the sole reason for deciding against the petitioner/applicant but the Deputy Director of Consolidation had held against the petitioner relying on the testimony of Khandua given before the revenue authorities and also on the ground that the sale deed propounded by the respondent had not been denied by the petitioner. It is also apparent from the judgment that Khandua had denied the execution of the gift deed propounded by the petitioner.

In view of the aforesaid, no grounds for review are made out.

The review application is dismissed.
