Heard learned counsel for the petitioner and Ms. Akanksha Dubey, learned State Counsel representing the respondents.

By means of instituting these proceedings under Article 226 of the Constitution of India, a prayer has been made to quash the order dated 05.09.1986 passed under Section 117(6) of U.P. Z.A. & L.R. Act, 1950(hereinafter referred to as the Act of 1950), whereby certain land comprised in Gata No.173,situated in Village- Sirkida, Pargana-Tambaur, Teshil- Laharpur, District-Sitapur is being grabbed by the state authorities.

Though a copy of the said notification/ order issued under Section 117(6) of Act of 1950 has not been annexed, however, Annexure No.1 has been annexed with the writ petition which is extract of Form PA 11, whereupon the said order has been incorporated on 17.04.1999, according to which an area of 0.202 hectare of the total area of 1.177 hectare of Gata No.173 was resumed.

Resumption was made in the year 1986 and there is no documents available on this writ petition which in any manner can even remotely establish any right or semblance of it so far as the petitioner is concerned over the subject matter of the notification dated 05.09.1986 issued under Section 117(6) of the Act of 1950.

In our considered opinion, the writ petition is highly misconceived. It is hereby dismissed.

We however make it clear that this petition and the judgment passed by us concerns only with the notification dated 05.09.1986 in respect of an area of 0.202 hectare of Plot No.173 situated in Village- Sirkida, Pargana-Tambaur, Teshil- Laharpur, District-Sitapur.
