1. Despite the matter being listed today peremptorily, no one has put in appearance on behalf of the revisionist to press this revision, which was instituted against the judgment and order dated 24.12.2007 passed by the learned Additional Sessions Judge/F.T.C.-2, District Faizabad (now Ayodhya Ji) in Sessions Trial No.234 of 2002, arising out of Crime No.30 of 2002, under Section 302/34 IPC as well as Sessions Trial No.271 of 2002, arising out of Crime No.50 of 2002, under Section 4/25 Arms Act both lodged at Police Station Tarun, District Faizabad (Ayodhya Ji).
2. Learned trial Court, after considering the evidence on record and, taking into consideration that all the witnesses of fact turned hostile and have not support the prosecution case, had acquitted the accused-respondents of the charges levelled against them in the aforesaid two trials.
3. This Court has perused the impugned judgment and order. The prosecution had failed to prove the case by leading cogent and credible evidence and the witnesses of fact had turned hostile. The learned trial Court has rightly acquitted the accused-respondents. This Court does not find any ground to interfere with the impugned judgment and order passed by the trial Court.
4. In view thereof, this revision fails, which is hereby dismissed.
