Heard learned Counsel for the petitioner and Ms. Pooja Agarwal, learned Counsel for the respondents.
The issue raised in the present writ petition being challenged to the order dated 18.01.2019 is similar to the issue decided by this Court today in Writ-A No.7267 of 2020 (Raj Bahadur vs Union of India and others).
In the present petition, the petitioner has been non-suited only on the ground of suppression of material facts without there being any finding with regard to the effect of the said suppression on the services sought by the petitioner.
For all the reasons as recorded in the judgment and order passed today i.e. 20.12.2022 in the case of Raj Bahadur (Supra), the present petition deserves to be allowed.
Accordingly, the order impugned dated 18.10.2019 is set aside and the writ petition is allowed.
The matter is remanded for a decision afresh in the light of the directions given in the case of Raj Bahadur (Supra).
The order shall be passed within a period of three months from the date of production of certified copy of this order.
