It is the contention of learned counsel for the petitioner that the petitioner's husband when was posted for the election duty in the Panchayat Elections, was infected with Covid-19 virus and thereafter died on 19.4.2021. The grievance of the petitioner is that despite the fact that an application for ex-gratia payment was moved before the Minister, Basic Education, Uttar Pradesh, Lucknow the amount had not been paid. Learned counsel contended that ex-gratia payment be made to the petitioner in view of the Government Order dated 1.6.2021 as also in view of the judgment of this Court in Kusum Lata Yadav vs. State of U.P. & Ors. (Writ-C No.28249 of 2021 decided on 25.7.2022).

Learned Standing Counsel and the learned counsel appearing for the Basic Education Officer state that the application of the petitioner would be considered on merits if the same is made to the competent authority under the Government Order issued by the State Government.

Since, we find that no proper representation has been filed, we direct the petitioner to file a fresh representation in view of the Government Order dated 1.6.2021 before the appropriate authority. If a representation is filed within a period of three weeks from today, the same shall be decided by the relevant authority within two months thereafter.

With these observations, the writ petition stands disposed of.
