We have heard learned counsel for the parties and perused the pleadings of writ petition.
Learned counsel for the petitioner has submitted that following the judgment of a Division Bench of this Court in the matter of Tajveer Singh v. State of U.P. and others, reported in 1997 Allahabad Journal page 285, several such matters have been disposed of.
Learned Standing Counsel also submits that the petitioner's case is covered by the ratio of judgment in Tajveer Singh's case. We are also informed that an Special Leave Petition filed against the said judgment was dismissed by Hon'ble the Apex Court.
Thus, we dispose of this writ petition and quash the impugned order in so far as it relates to demand of stamp duty from the petitioner on the security deposit. However, the respondents would be free to realize the stamp duty, if not being already paid, from the petitioner under Article 57 Scheduled 1-B of the Stamp Act as amended by the State of U.P.
The writ petition, thus, stands disposed of.
