Citation : 2022 Latest Caselaw 19414 ALL
Judgement Date : 1 December, 2022

Allahabad High Court
Shakari Mandi Samiti Allahabad vs Mohan Lal And Another on 1 December, 2022
Bench: Ajay Bhanot

HIGH COURT OF JUDICATURE AT ALLAHABAD

?Court No. - 7

Case :- FIRST APPEAL No. - 174 of 2003

Appellant :- Shakari Mandi Samiti Allahabad

Respondent :- Mohan Lal And Another

Counsel for Appellant :- B.D.Mandhyan,Sc Dwivedi

Counsel for Respondent :- B.P. Misra,Rajendra Prasad

Hon'ble Ajay Bhanot,J.

Heard Sri S.C. Dwivedi, learned counsel for the appellant.

The appeal is pending for the last 23 years. Valuation of the appeal is Rs. 4642/-. Perusal of the judgment shows that this appeal has been filed against marginal enhancement of compensation by the Land Acquisition Compensation Tribunal/ Special Judge, Allahabad in Land Acquisition Reference No. 56 of 1987.

Learned counsel for the appellant submits that similar matters have been dismissed by this Court in State of U.P. through District Magistrate Bulandshahr Vs. Khempal & others (First Appeal No.818 of 2004 decided on 9.8.2016) on the footing that the valuation is low and the disputed amount is small.

Learned counsel for the appellants fairly concedes that this case is also covered by the judgment rendered in Khempal and others (supra) in view of the paltry amount which is in dispute.

The appeal is dismissed.
