Sri Ankit Srivastava,learned State counsel is present, who has been heard.

The present appeal has been filed by the appellant Chandra Pati against the judgment and order dated 29.02.1990 passed by Additional Sessions Judge, Azamgarh in Sessions Trial No. 151 of 1987 arising out of Case Crime No. 166 of 1984, Police Station Nijamabad, District Azamgarh.

As per office report dated 09.05.2022 a report from C.J.M. concerned was called for regarding living status of the appellant in present appeal. In compliance of the said order, C.J.M. concerned vide letter dated 20.12.2021 informed that the appellant/Chandra Pati has died on 25.06.2013. In support of which a report of concerned police station and the copy of death certificate have also been annexed thereto.

Accordingly, the appeal stands abated.

Office is directed to communicate this order to the District and Sessions Judge concerned within two weeks from today.
