This appeal has been presented on behalf of three appellants, namely, Gambhir, Dharmpal and Om Prakash against the judgment and order dated 16.11.1994, passed by IInd Additional Sessions Judge, Moradabad in Sessions Trial No.369 of 1991 convicting and sentencing the appellant no.1 (Gambhir) to imprisonment for life under Section 302 IPC and appellants 2 and 3 (Dharmpal and Om Prakash) to imprisonment for life under Section 302 read with section 34 IPC.

The office has submitted report dated 16.04.2022 that information has been received from Chief Judicial Magistrate, Moradabad that all the three appellants have died. The letter of the Chief Judicial Magistrate, Moradabad dated 04.12.2021 is Flagged 'A' on the record from which it appears that all the three appellants have died. The appellant no.1 (Gambhir) is stated to have died on 14.11.2005; the appellant no.2 (Dharmpal) died on 31.03.2021 and appellant no.3 (Om Prakash) died on 12.08.2021. The necessary documents and report in respect of death of all the three appellants are there on record.

In view of the above, the appeal stands abated.
