HIGH COURT OF JUDICATURE AT ALLAHABAD, LUCKNOW BENCH ?Court No. - 8 Case :- SECOND APPEAL No. - 15 of 2018 Appellant :- Kamlesh Singh Respondent :- Shanta Prasad And Another Counsel for Appellant :- Umesh Chandra Pandey Counsel for Respondent :- Atma Ram Verma,Karunakar Srivastava,Madan Gopal Tripathi Hon'ble Vivek Chaudhary,J.
Order on C.M.Application No. 85282 of 2018
Heard learned counsel for the parties.
Learned counsel for the respondents submits that the suit for injunction filed by the appellant before this court was decreed by the trial court, but, the same was dismissed by the first appellate court.
This court while admitting the appeal on 10-01-2018 directed that the operation of the impugned Judgment and decree of first appellate court dated 14-11-2017 passed in Civil Appeal No. 19 of 2011, Shanta Prasad and another Vs. Kamlesh Singh, shall remain suspended. The same is vague in nature and does not prescribe the impact and scope of the order.
I have considered the submissions of learned counsel for both the parties and perused the order dated 10-01-2018.
The order dated 10-01-2018 is modified to the extent that the parties are directed to maintain status-quo with regard to the property in dispute.
The application stands disposed of.
