The High Court of Karnataka has ruled in favour of granting divorce to a man, emphasizing that insulting a person based on their skin colour constitutes cruelty. The Court's decision came in response to an appeal filed by the husband, who sought divorce due to his wife's demeaning behaviour towards his dark complexion.

A division bench consisting of Justices Alok Aradhe and Anant Ramanath Hegde highlighted the wife's decision to distance herself from her husband and make false allegations of illicit relationships against him to cover up her discriminatory behaviour. The Court emphasized that these actions by the wife were cruel and amounted to mental and emotional abuse.

The Court's verdict was based on an appeal filed by the husband, challenging the dismissal of his divorce plea by a family court in Bengaluru. The husband had asserted that his wife consistently insulted him based on his skin colour and had even filed false complaints against him and his family members.

The husband's plea was supported by evidence indicating the wife's derogatory remarks and her refusal to reconcile with her husband. The Court observed that the wife's allegations of illicit relationships were baseless and aimed at concealing her discriminatory behaviour.

The High Court further criticized the Family Court for not adequately considering the impact of groundless accusations on the husband's character and for failing to recognize the gravity of the wife's actions.

The Court's ruling stressed the importance of upholding the principles of equality and respecting each other's dignity within a marriage. It also emphasized that such demeaning behaviour can have severe emotional and psychological effects, leading to a breakdown of the marital relationship.

In light of these findings, the High Court granted the husband's plea for divorce and dissolved the marriage. The verdict serves as a reminder that respecting each other's individuality and treating one another with kindness and empathy are crucial for maintaining a healthy and harmonious relationship.
