The Single Bench of the Delhi High Court in the case of Neetu Singh vs Telegram FZ LLC consisting of Justice Prathiba M. Singh held that Telegram disclosed the channels/devices, mobile numbers, IP addresses and email addresses used in disseminating infringing content.
Facts
The discovery application I.A.8461/2020 was disposed of on 30th August 2022. Defendant No.1/Telegram FZ LLC ("Telegram”) was directed to disclose the channels/devices used in disseminating the infringing content, mobile numbers, IP addresses, email addresses, etc., used to upload and communicate the infringing material.
Telegram filed an affidavit on 6th October 2022, deposed by Major Lakshmiraj Rathore, as Authorized Representative, indicating that the available data had been given over in a sealed cover to the affidavit. In the affidavit, Telegram clarified that some data relating to some channels was not available because it had to preserve the same as per law, initially for 90 days under Rule 3 of the Information Technology (Intermediaries Guidelines) Rules, 2011, and then for 180 days under Rule 3(2) of the Information Technology (Guidelines for Intermediaries and Digital Media Ethics Code) Rules, 2021.
Order
The court evaluated the data in the form of a chart and uncovered the admins' names, phone numbers, and IP addresses of various Telegram channels. It ruled that ld. Counsel for Plaintiffs be given a copy of the data with the instruction that neither the Plaintiffs nor their counsel reveal the material to any third party. Government/police were allowed to access. Telegram's affidavit and data chart were recorded. Registry was told to seal the data. This matter was set for the Joint Registrar on January 9 and the Court on February 14, 2023. It noted this shouldn't be considered as a part-heard matter. Matter was to be listed before the Roster Bench.
