The Orissa Granthayan (Book Promotion) Rules, 1995

Notification No. 1296-S.C. dated 10.3.1995. - With view to promoting publication of books of qualitative excellence in various genres, the State Government of Orissa have been pleased to frame the following rules, namely :
- Short title and commencement.- (1) These rules shall be called the Orissa Granthayan (Book Promotion) Rules, 1995, mentioned hereinafter as these rules.
(2) These rules shall come into force with immediately effect.
- Definition.- In these rules, unless the context signifies otherwise:
(a) "Akademi" means the Orissa Sahitya Akademi;
(b) "Advisory Council" means the Advisory Council specified in Sub-rule (1) of Rule 5;
(c) "Culture Secretary" means the Secretary to Government of Orissa, Department of Culture;
(d) "Department" means the Department of Culture, Orissa;
(e) "Monitoring Committee" means the Monitoring Committee of the Advisory Council specified in Sub-rule (2) of Rule 5; and
(f) "National Akademi" means the National Sahitya Akademi (National Academy of Letters).
- Objects.- The objects of these rules are, inter alia, as follows:
(a) Promotion of books of qualitative excellence in various genres;
(b) Promotion of literary creativity amongst the youth;
(c) Publication of authentic editions of classic works;
(d) Enrichment of Oriya literature and dissemination thereof through translation of outstanding works from Oriya into Hindi/English and from other languages into Oriya; and
(e) Market intervention through model publishing practices for emulation by publisher in the public and private sectors.
- Executing agency.- The scheme as per these rules shall be executed through the Akademi and various publishers of repute.
[5. Advisory Council. - (1) There shall be an Advisory Council comprising the Culture Secretary, the President and the Vice-President of the Akademi, the recipients of the National Akademi award for Oriya, the receipts of the Atibadi Samman of the Akademi and five other litterateurs nominated by the Executive Board of the Akademi
(2) The Monitoring Committee shall comprise the Culture Secretary, the President and the Vice-President of the Akademi, three National Akademi awardees nominated by Government and two other members of the Advisory Council nominated by Government. The nomination shall ordinarily be made for a term of three years.
(3) The Monitoring Committee shall meet from time to time. The Culture Secretary (or any other functionary nominated by him) shall act as the convenor. Members of the Monitoring committee shall preside in the meetings on rotative basis. The Monitoring Committee may co-opt any person having the required expertise in any of its meetings]
- Three-Year Plan.- The Monitoring Committee shall finalise, in the manner indicated hereinafter, a three-year plan for annual programme of publication of at least one hundred books ordinary. During the third-year, the Monitoring Committee shall prepare the next three-year plan and so on.
- Annual programme.- The annual programme (out of the three-year plan) of publication shall comprise the following segments :
(a) Authentic versions of ancient and medieval texts, edited by the Directorate of Culture, Orissa Sangeet Natak Akademi, Orissa Sahitya Akademi other autonomous bodies created by Government and scholars of national repute;
(b) Translation of outstanding works of contemporary Oriya literature into Hindi or English;
(c) Translation of outstanding works of other languages into Oriya;
(d) Works of essays/criticism/research studies and texts of Memorial Lectures instituted by the State Government/Akademi;
(e) Works of creative literature in the genres of novel, short stories, drama and poetry, which shall be at least half the total number of publications brought out during a year; and
(f) Miscellaneous works of other categories, especially those concerning aesthetics, creativity and folk/tribal and culture;
- Modalities for selection of texts.- (1) The three-year plans shall be finalised by the Committee by shortlisting (on the basis of overall excellence) the names of authors suggested by the members of the Advisory Council.
(2) The listed authors (or their representatives) shall be requested to kindly offer one of their works for publication under these rules. Unless there is exceptional justification for special dispensation, only one work of an author shall ordinarily be covered in the three-year plan. The texts of the Memorial Lectures shall invariable be published every year.
(3) Selection of authentic versions of ancient and [medieval] texts for publication shall be finalised on the recommendations of the Department/ Directorate of Culture.
(4) At least ten works of creative literature of the genres-specified at Clause [(e)] of Rule 7 shall ordinarily be selected from among the outstanding works by comparatively younger writers to be published for the first time.
- Royalty and honorarium.- (1) As regards original works, the author or the person authorised to hold the copyright on his behalf shall be entitled to twenty per cent of the printed price as royalty.
(2) As regards works of translation, the translator shall be entitled to five percent, out of the twenty per cent of printed price mentioned above, as royalty, except in case where the texts of translation have been prepared by one-time payment of honoraria to the translators.
(3) As regard edited works, an amount of lump sum honorarium may ordinarily be paid. For work which had been prepared by salaried Editors of the Director of Culture, no honorarium need be paid.
- Printing and price fixation.- (1) The Monitoring Committee shall assign the tasks of printing and publication to the (a) Akademi and (b) other reputed publishers, preference being given to (i) publishers which have published works of National/State Akademi Awardees, (ii) publishers who have at least ten significant title of publication to their credit and (iii) reputed creative writers publishing their own books.
(2) The executing agency shall ensure that the printing is error-free and that the production-standard the books is satisfactory.
(3) Ordinarily, at least one thousand, first edition copies of a book shall be printed under these rules.
(4) The formula of fixation of price per copy of a book shall ordinarily be double the actual cost of production, divided by the number of copies printed.
[(5) Subject to such guidelines as the Monitoring Committee may formulate, the fixation of the price of a book shall be finalised by the executing agency as per the provisions of this rule.]
- Miscellaneous Provisions.- [(1) Subject to maintenance of the qualitative standard, the books published as per these rules may be covered for procurement under various Government programmes of purchase such as the Raja Rammohan Roy Library Foundation Scheme. The executing agencies may be required to furnish such particulars about payment of royalty to the authors (or those authorised to hold copyright on their behalf) as may be decided by the Monitoring Committee.]
(2) Notwithstanding anything contained herein before, the Monitoring Committee may finalise special arrangement with reputed institution and publishing houses outside the State in order to promote publication work of translation of contemporary Oriya Literature into other languages.
(3) The decisions of the Advisory Council and the Monitoring Committee shall be final and shall not be questioned at any quarters.
(4) If any doubt arises regarding any of the provisions of these rules, the matter shall be referred to the Government for final interpretation.
