No. JSERC/64/16 dated the 29th April, 2008. - In exercise of the powers conferred on it under Chapter 21 of JSERC (Electricity Supply Code) Regulations 2005 and other powers enabling it in that behalf, the Jharkhand State Electricity Regulatory Commission hereby makes the following amendment to the said Regulation:-

1. Short title and commencement.- This shall be called Jharkhand State Electricity Regulatory Commission (Electricity Supply Code) Second Amendment Regulation, 2008.
2. They shall come into force from the date of publication in official gazette.
3. They extend to the State of Jharkhand.
4. The Words and expressions occurring in this order and not specially defined herein shall bear the meaning as in the Electricity Act 2003.
5. The following amendments to the JSERC (Electricity Supply Code) Regulations 2005 are hereby made:

Amendment to Regulation 15.4. - Wherever unauthorized use of electricity is being indulged in, the licensee may discontinue the electricity supply so long as such unauthorized use of electricity is being done without prejudice to the right of the licensee to take action under law including Section 126 of the Act.

Amendment to Regulation 15.5. - An assessment of the compensation (the electricity charges) payable to the licensee for theft of electricity under the meaning of Section 135 of the Act shall be done in accordance with the provisions of Section 126 of the Act.
