Mohit D. Ram, Standing Counsel representing Election Commission of India (ECI) against the “Murder Charges” remark made by Madras High Court resigned from his post in the Supreme Court stating that his values are not in consonance with the working methodology of the ECI.

He further expressed that:

“It was an honour to represent the Election Commission of India (ECI). I had a cherishing milestone of my career, in the journey which began with being part of the office of Standing Counsel of ECI and progressed as one of the panel counsels of ECI (since 2013).”

In the resignation letter, Mohit D. Ram stated his reason for resignation as:

“I have found that my values are not in consonance with the current functioning of the ECI; and hence I withdraw myself from the responsibilities of its panel counsel before the Supreme Court of India”.

This move was taken by the Counsel after Apex Court dismissed the plea made by the Commission to restrain media from reporting oral remarks of judges.

Factual Background

The Madras HC had orally remarked that Murder charges should be initiated against the officials of the ECI. The remark was not penned down in the order which was passed on the same day. On the other hand, the media made the hype of that remark which created prejudice in the mind of people and several complaints were also registered against the officials of the ECI.

The ECI appealed in Madras High Court first- to refrain the media publications to publish the oral remarks. Madras High Court dismissed the plea. Therefore, the Commission approached Supreme Court against the Madras HC judgment. SC also dismissed the Petition.
