Recently, the High Court of Madhya Pradesh  issued notice in a Public Interest Litigation seeking regulation of e-rickshaws and restriction on their operation over national and state highways. The Division Bench comprising Justice Anand Pathak and Justice Pushpendra Yadav was hearing a plea filed by Nisha Gurjar raising concerns over the absence of a regulatory framework governing e-rickshaws.

According to the petition, e-rickshaws have been operating on roads for nearly a decade, yet neither the Union Government nor the State Government has framed specific rules for their regulation. The Petitioner further contended that e-rickshaws should not be allowed to ply on national and state highways as they pose safety risks and also cause revenue loss to the State Exchequer due to exemption from the tax regime. It was additionally argued that unrestricted movement of e-rickshaws on highways adversely affects other permit holders operating commercial vehicles on such routes.

The counsel for the Petitioner submitted that the absence of a proper policy framework has resulted in regulatory gaps and road safety concerns. Deputy Solicitor General Praveen Kumar Newaskar appeared for the Union of India, while Government Advocate G.K. Agrawal represented the State authorities.

After hearing the matter, the Court issued notice to the Respondents and directed them to file their replies within four weeks. The matter has been listed for further consideration after service of notice.
