The Division Bench of the Patna High Court, comprising Chief Justice K. Vinod Chandran and Justice Rajiv Roy has takes suo moto cognizance to a news report about a distressing incident involving three Bihar policemen who were caught on video throwing the dead body of an accident victim into a canal in Muzaffarpur district.
The Bench quoted Sir William E. Gladstone that “Show me the manner in which a nation cares for its dead and I will measure with mathematical exactness the tender mercies of its people, their respect for the law of the land and their loyalty to high ideals.”
The Court also paid reliance to National Human Rights Commission Advisory for 'Upholding the Dignity & Protecting the Rights of the Dead' and expounded that many believe that bodies, without life, are dispensable repositories of the soul, but when alive, it carries a soul; the part of a whole, which exists in every living being. A little more respect and a lot more dignity in its disposal is required.
Therefore the Court listed the matter on 31.10.23 for next hearing
