NEW DELHI: AAP MLA Pramila Tokas could face two years’ jail term or fine or both after she is convicted of assault and deterring a central government official from carrying out the demolition of unauthorised slum clusters four years ago.

Besides Tokas, special judge Arun Bhardwaj convicted her husband Dheeraj Tokas and three others for the offence under Section 353 of IPC as well.

The law says that whoever assaults or uses criminal force on any public servant executing his or her duty shall be punished with up to two years imprisonment, or fine, or both.

 Central Public Works Department (CPWD) executive engineer Gyani Ram alleged that on December 15, 2015, during a demolition drive in New Delhi’s R K Puram, the AAP lawmaker along with her husband and supporters interfered and forcefully stopped the work.

 In addition to the witnesses, the court relied on a footage of the incident to conclude that all accused had used “criminal force”. During its probe, the police had collected a footage of the incident, which showed the other three accused, Ravi Kumar, Mahinder Verma and Rajender Kumar.

 The complainant had also alleged that during the melee, Dheeraj passed casteist slurs at him. Judge Bhardwaj, however, noted that Ram had not mentioned about it in his complaint on the day of the incident. He said it two days later.
