3. Learned counsel for the Petitioner submits that the present matter is squarely covered by the judgment of the Co-ordinate Bench passed in Criminal Revision No. 201 of 2013, "Lt. Colonel (Retd.) Balraj Singh Lamba and Another vs. State of Uttarakhand and Another", decided on 23.12.2022.

4. The matter is listed on 10.01.2026 as a fresh case.

5. Learned State Counsel shall apprise this Court on the said point on the next date fixed.
