Mr. Sanjay Kumar, learned counsel for the applicant.

2. Mr. J.S. Virk, learned Deputy Advocate General for the State.

3. The applicant-Angad Singh is accused in Case Crime/FIR No.05 of 2026, under Sections 8/20/60 of NDPS Act, Police Station Salt, District Almora. He has sought his release on short term bail.

4. Learned counsel for the applicant is pressing the short term bail of the applicant on medical ground.

5. In para 4 of the affidavit in support of the short term bail application, there is a categorical statement that the applicant has diabetes history and was under regular treatment, but in the jail, the proper care and treatment of the applicant was not ensured, consequently, he reached to the serious condition and at present, the applicant is in I.C.U. of Sushila Tiwari Hospital, Haldwani, but his condition is still not stable. In para 5 of the said application, it is further stated that the applicant is under the need of proper care and treatment, which is not possible in the jail custody. The applicant wants to get his treatment elsewhere under the care of his parents and relatives, therefore, for the sake of liberty to live as provided under Article 21 of the Constitution of India, applicant deserves to be released on interim/short term bail looking to the medical condition of the applicant.

6. Mr. J.S. Virk, learned Deputy Advocate General for the State does not dispute these above statements made in the affidavit of the applicant. He may also file counter affidavit within four weeks.

7. In that view of the matter, the short term bail application is allowed.

8. Without adverting to the merit purely on humanitarian grounds, this Court is of the view that the applicant may be enlarged on short term bail for one month from the date of his release.

9. Accordingly, the applicant shall be enlarged on short term bail for a period of one month from the date of his release on furnishing two reliable sureties, each of the like amount, to the satisfaction of the court concerned. Since the applicant is stated to be in hospital, he is exempted from executing the personal bond.

10. The applicant is directed to forthwith surrender himself after the expiry of the aforesaid period.

11. The short term bail application (IA No.1 of 2026) stands disposed of accordingly.

12. List this case on 11.03.2026.
