2. Mr. Baskar Chandra Joshi, learned AGA and Mr. Chitrarth Kandpal, learned Brief Holder for the State/respondent nos.1, 2 & 4.
3. In a similarly placed case, the co-accused, Kulvinder Singh and others, have been granted interim relief by the Coordinate Bench of this Court vide order dated 16.01.2026.
4. Admit.
5. Issue notice to respondent no.3, returnable within two weeks. Steps to be taken within one week.
6. Objections, if any, to be filed by the respondents within a period of three weeks.
7. List this matter on 15.04.2026.
8. In the interregnum, it is directed that the investigation shall proceed but the petitioners shall not be arrested by the police in connection with the impugned FIR dated 12.01.2026 registered as FIR/Case Crime No.0013 of 2026 for the offence punishable under Sections 108 & 318(4) of BNS, 2023 at Police Station I.T.I., District Udham Singh Nagar. However, they will continue to cooperate with the Investigating Officer of the case and shall remain present, as and when required for production of documents and for recording of their statements.
9. Stay Application (IA No.02 of 2026) stands disposed of.
