Mr. Nalin Saun, learned counsel for the Appellant.
2. As per observation of this Court dated 17.03.2026. The notice so issued to the Respondent had been served personally and thereby the service was considered to be sufficient. There is no representation from the Respondent.
3. Trial Court Record has been received. Let the paper- book be furnished to the learned counsel for the parties on the payment of usual charges.
4. The present application has been filed by the Appellant seeking special leave to appeal against the judgment and order dated 11.07.2025, passed by the court of learned ACJM/6th Additional Civil Judge (S.D.), Dehradun in Criminal Complaint Case No.1988 of 2019, "Amarjeet Singh Vs. Asha Vialapoal", whereby acquitting the Respondent/accused for the charges under Section 138 of the Negotiable Instruments Act.
5. Heard on the special leave to appeal.
6. After hearing the learned counsel for the Appellant, the present matter needs deliberation, this Court is satisfied that the Appellant has made out a prima facie case warranting consideration. Special leave to appeal is granted.
7. The application is treated as an appeal and is admitted.
