2. Mr. Yogesh Pandey, learned D.A.G. with Mr. Manoj Bhatt, learned B.H. for the State.
3. Petitioners, in the present writ petition, are Junior Engineer, Executive Engineer and Assistant Engineer working with the State of Uttarakhand in the Department of Irrigation; however petitioner no.3 has already been retired from service.
4. By means of the present writ petition the petitioners have challenged certain recovery to be made from the petitioners for some irregularity having been committed in the construction of a Motor Road at Patoli Kalaun, District- Pauri Garhwal.
5. Since the petitioners are Government Servants, therefore, in the opinion of this Court this writ petition would lie before the service Bench.
6. Registry is directed to place this writ petition before the service bench as per Roaster.
