The instant appeal has been preferred against judgment

and order dated 22.02.2018, passed in Special Sessions Trial No.03

of 2016, State Vs. Rajesh Kumar, by the court of Sessions Judge/

Special Sessions Judge, Champawat. By it, the appellant has been

convicted and sentenced under Section 8/20 Narcotic Drugs and

Psychotropic Substances Act. He seeks bail.

2. Learned counsel for the appellant would submit that the

appellant has already undergone more than half of the sentence

imposed upon him and there is less chance of appeal being heard in

near future.

3. The period of the custody, which the appellant has

undergone, has been admitted by the learned State Counsel.

4. Having considered, this Court is of the view that it is a

case in which the execution of sentence should be suspended and

the appellant be enlarged on bail.

5. The bail application is allowed.

6. The sentence appealed against is suspended during the

pendency of the appeal.

7. The appellant- Rajesh Sharma be released on bail during the

pendency of the appeal on his executing a personal bond and

furnishing two reliable sureties, each of the like amount, to the

satisfaction of the court concerned.

8. Since the appeal has already been admitted, list in due

course for final hearing.
