Mr. V.K. Kapruwan, learned counsel for the petitioners.

2. This writ petition has been filed, under Article 227 of the Constitution of India, by the petitioners to quash the impugned order dated 31.01.2025, passed by learned Appellate Authority under the Payment of Gratuity Act, 1972, in Appeal No.38 of 2024, Uttarakhand Van Vikas Nigam Ltd. and others Vs. Controlling Authority and another, and the impugned decision dated 02.07.2024, passed by learned Controlling Authority, Payment of Gratuity Act, 1972/Assistant Labour Commissioner, Kotdwar, Pauri- Garhwal in PGA Case No.23 of 2023, Ramswaroop Singh Vs. M/s Uttarakhand Forest Department Corporation and another, whereby gratuity was awarded to the respondent by the learned Controlling Authority, and the said order was affirmed by the Appellate Authority.

It is contended by the learned counsel for the petitioners that the entire amount awarded under the impugned judgment and orders has been deposited by the petitioner-Uttarakhand Forest Development Corporation before the Appellate Authority. Pleading to this effect has been made in para no.20, which reflects that a sum of ₹4,13,100/- has been deposited in compliance with the requirement under Section 7(7) of the Payment of Gratuity Act, 1972.

4. Issue notice to the respondent, returnable within two weeks.

5. Steps to be taken within a week.

6. List this case on 10.11.2025.

7. In the meantime, respondent may file the counter affidavit.
