The applicant - accused was summoned for the offence under Section 197 and Section 75 of the Bharatiya Nyaya Sanhita, 2023 in Complaint Case No.2842 of 2024. Against the said order dated 17.12.2024, a Criminal Revision (Criminal Revision No.36 of 2025) was filed by the applicant. The said revision has been dismissed vide judgment dated 05.08.2025, passed by learned IIIrd Additional Sessions Judge, Rudrapur, District Udham Singh Nagar. Hence, the present Application under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023.

2. Heard Mr. Harsh Vardhan Dhanik, learned counsel for the applicant and Mr. Pradeep Lohani, learned Brief Holder for the respondent no.1.

3. Mr. Harsh Vardhan Dhanik, Advocate, has submitted that the applicant is the Department Head of Neel Metals Products Private Ltd., Pantnagar, District Udham Singh Nagar. The respondent no.2 - complainant has been working in the said institute since February, 2012. Respondent no.2 misbehaved with a fellow worker and the said incident was reported to the applicant, who immediately reported the said incident to the HR of the said Company through e-mail (Annexure No.1). The respondent no.2 after this incident came to the applicant's office and tried to threaten him. This incident is captured in CCTV camera (Annexure No.2). The respondent no.2 just to create pressure has filed the said complaint case against the applicant

4. Notice is being issued to the respondent no.2- complainant. Steps to be taken within four days.

5. List on 07.11.2025. Till then, the further proceedings of the said Complaint Case No.2842 of 2024 are stayed.
