2. Mr. S.S. Chauhan, learned Deputy Advocate General with by Mr. Bhaskar Chandra Joshi, learned AGA assisted by Mr. Vikas Uniyal, learned Brief Holder for the State.

3. Heard learned counsel for the parties.

4. Present criminal revision is being preferred against the judgment and order dated 18.12.2024 passed by the Third Additional Sessions Judge, Rudrapur, District Udham Singh Nagar in Criminal Appeal No.237 of 2017 Gulfam vs. State of Uttarakhand whereby the Criminal Appeal filed by the revisionist has been partly allowed and conviction judgment and order dated 16.11.2017 passed by Judicial Magistrate/Civil Judge (S.D.), Rudrapur, Udham Singh Nagar in Criminal Case No.1291 of 2017 under Section 379/411 of IPC may be set aside.

5. Vide order dated 14.07.2025 passed by the Coordinate Bench of this Court the delay of 76 days has already been condoned.

6. The matter is listed for disposal of bail application.

7. No order regarding admission has been made.

8. Admit.

9. Let the objection be filed by the State within two weeks.

10. List this revision on 15.10.2025.

11. Heard on bail application.

12. Without going into the merits of the case and considering the fact that the revisionist had been enlarged on bail during the pendency of trial at this juncture, this Court finds the sufficient ground to enlarge the applicant on bail during the pendency of present revision.

13. Accordingly, the bail application is allowed. Let the Revisionist-Gulfam be enlarged on bail during the pendency of this revision on furnishing a personal bond and two sureties of each amount to the satisfaction of court concerned.
