Mr. Pankaj Joshi, learned AGA for the State/appellant.
2. The State proposes to challenge the judgment and order dated 01.05.2023 passed in Session Trial No.40 of 2019, State Vs. Vipin Kumar, by the court of 5th Additional Session Judge, District Haridwar. By it, the respondent has been acquitted of the charge under Sections 304-B and 302 of IPC. There is a delay of 92 days.
3. Respondent was required to file objection, but no objection has been filed. In fact, today respondent is not represented.
4. Having considered the grounds taken in the affidavit enclosed with the delay condonation application, this Court is of the view that there is a good ground to condone the delay, therefore, the delay in preferring the appeal is condoned and the delay condonation application stands allowed accordingly.
5. In order to appreciate the argument on admission, call for LCR.
6. List this matter on 06.01.2026 for admission.
