Hon'ble Ravindra Maithani, J.
Mr. Tapan Singh, Advocate for the petitioner.
Mr. Devesh Ghildiyal, Brief Holder for respondents.
The petitioner has brought to the notice of the Court that order dated 18.11.2024, passed in WPSS No. 629 of 2023, Shiristi Shah Vs. State of Uttarakhand and others has been wilfully disobeyed by the respondents, by which, the respondents were directed to consider the claim of the petitioner for compassionate appointment strictly as per the Rules, and further taking into consideration her eligibility, and if the vacancy is not available, the respondents shall create supernumerary post for giving compassionate appointment to the petitioner within a period of six weeks from the date of production of certified copy of the judgment. It has yet not done. Today, a statement is given by the learned State Counsel that the matter has been referred to the Additional Director.
This Court is not concerned with the hierarchy of the Executives, at which level the decision is taken. It is the respondent State to comply with the Court's order.
Issue notice to the respondent no.1 to join the proceedings through video conferencing on 18.12.2025, as to why charges may not be framed against him for wilful disobedience of the Court's order.
List on 18.12.2025.
(Ravindra Maithani, J.) 27.11.2025 Sanjay
