(2) By means of this writ petition, petitioners have sought the following reliefs:

"i) Issue a writ, order or direction in the nature of Certiorari to quash/set-aside the order dated 26.09.2024 (contained as Annexure no. 7 to this writ petition) by respondents, whereby the respondents have rejected the Application of the applicants who have completed D.El.Ed through NIOS for the Post of Assistant Teacher Primary in their respective districts.

ii) Issue a writ, order or direction in the nature of Mandamus directing the respondents to consider the candidature of the petitioners, for the post of Assistant Teacher Primary in pursuant to the advertisement dated 10.06.2024, at par with the candidates having 2 year D.El.Ed."

(3) Learned State Counsel submits that in view of the judgment rendered by Hon'ble Supreme Court in Civil Appeal No. 7873 of 2023, Vishwanath v. State of Uttarakhand, candidates who have obtained D.El.Ed from NIOS are now being treated as eligible for appointment as Assistant Teacher in Govt. Primary School. He thus submits that in view of the said decision, petitioners' candidature for appointment as Assistant Teacher shall also be considered, if they have applied pursuant to the advertisement dated 10.6.2024.

(4) Accordingly, writ petition is disposed of by taking the statement made by learned State Counsel on record.
