The present criminal revision under Section 438/442 of BNSS, 2023 is moved on behalf of the Revisionist to set-aside the impugned judgment and order dated 08.09.2025 passed by learned Judge, Family Court, District Pithoragarh in Misc. Criminal Case No.25/2021 (new Misc. Criminal Case No.06/2024), titled as "Bhagirathi Devi vs. Dharampal Singh under Section 125 of Cr.P.C.

5. Admit.
6. Issue notices to the Respondent no.1, returnable within two weeks. Steps to be taken within one week.
7. Objections, if any, to be filed by the Respondents within three weeks.
8. List this matter on 03.01.2026.
9. Till the next date of listing, the effect and operation of the impugned judgment and order dated 08.09.2025 passed by learned Judge, Family Court, District Pithoragarh in Misc. Criminal Case No.25/2021 (new Misc. Criminal Case No.06/2024), titled as "Bhagirathi Devi vs. Dharampal Singh" under Section 125 of Cr.P.C., shall remain stayed to the extent that the Revisionist/husband shall deposit 30% of the arrears before the court below. In default of the same, the stay shall stand vacated automatically.
