Instant appeal is preferred against the judgment and order

dated 07.06.2023, passed in Special Sessions Trial (POCSO) No. 31 of

2019, State of Uttarakhand Vs. Shivendra Kumar Singh, by the court

of Special Sessions Judge, Champawat. By it, the appellant has been

convicted under Section 354 (A) (i) IPC and Section 9(c)/10 and

9(m)/10 of the Protection of Children From Sexual Offences Act, 2012

("the Act") and sentenced under Section 9(c)/10 of the Act. He seeks

bail in this appeal.

2. Heard learned counsel for the parties and perused the

record.

3. This is an admitted appeal.

4. List in due course.

5. It is argued that the appellant has undergone half of the

sentence in custody. There are less chances of appeal to be heard in

near future. It is admitted by the learned State counsel.

6. Having considered, this Court is of the view it is a case in

which the execution of sentence should be suspended and the

appellant be enlarged on bail.

7. The bail application is allowed.

8. The sentence appealed against is suspended during the

pendency of the appeal.

9. The appellant be released on bail, during the pendency of

the appeal, on his executing a personal bond and furnishing two

reliable sureties, each of the like amount, to the satisfaction of the

court concerned.
