The proposed Revision has been filed against the judgment and decree dated 01.10.2024, passed by learned Judge, Small Cause Court/District Judge, Haridwar in SCC Suit No.07 of 2023, whereby, the learned Judge has decreed the suit for recovery of possession, rent, mesne profit with other consequential reliefs.
2. Heard Mr. Narenda Bali, learned counsel for proposed revisionist and Mr. Birendra Singh Adhikari, learned counsel for respondent.
3. Mr. Narendra Bali, Advocate, submitted on instruction that the revisionist is ready to hand over the vacant possession of the property-in- question within eleven months from today along with mesne profits at the rate of Rs.11,000/- per month or allow to revisionist to hand over the property-in- question within one and a half year with mesne profits at the rate of Rs.13,000/- per month.
4. Mr. Narendra Bali, Advocate, has sought one week's time to file an affidavit of the revisionist in this regard.
5. Admit.
6. List on 23.05.2025. Till then, further proceedings of Execution Case No.01 of 2024 are stayed on the conditions that the revisionist shall deposit/pay the entire decreetal amount by the date fixed.
