State proposes to challenge the judgment and order dated 27.08.2024, passed in Special Sessions Trial No.10 of 2018, State Vs. Bhuwan Nath Goswami and Another, by the court of Special Judge (Anti Corruption Act)/Second Additional Sessions Judge, Haldwani, Nainital. By it, the respondents have been acquitted of the charge under Sections 7, 13(1)(d) read with 13(2) of the Prevention of Corruption Act, 1988. It is delayed. Delay Condonation Application, IA No.1 of 2025, has been filed.

Objections have also been filed on it by the respondent no.2.

Heard.

It is the case of the appellant that in the process of granting sanction of appeal from the law department and completing necessary formalities, the delay had occurred. The delay is of 94 days.

It has not been strongly objected to by learned counsel for the respondents.

Having considered, this Court is of the view that there are good grounds to condone the delay.

The delay condonation application is allowed.

The delay is condoned.

Learned State Counsel would submit that she would like to argue on admission once paper book is given to her.

Let call for the LCR.

Once it is received, let a paper book be prepared and provided to learned counsel for the parties, as per rule. List thereafter for hearing on admission.
