3. This is a Jail Appeal preferred against the judgment and order dated 14.02.2024, passed by the learned District and Sessions Judge, Bageshwar, in Special Sessions Trial No. 17 of 2023. By the said judgment and order, the appellant/convict was convicted for the offence of aggravated penetrative sexual assault/rape against a minor girl aged eleven years. The appellant/convict was sentenced to undergo five years of rigorous imprisonment, along with a fine of ₹5,000/-, and in default of payment of fine, to further undergo six months of simple imprisonment under Sections 511 and 376 of the IPC and Section 10 of the POCSO Act, 2012. The benefit under Section 428 Cr.P.C. was also granted to the convict for the period already undergone during trial, as per the jail manual.
