2. Mr. S.K. Nainwal, learned Standing Counsel for the State of Uttarakhand.

3. By means of this writ petition, petitioners have sought the following relief:-

(i) To issue a writ, order or direction in the nature of certiorari to quash the judgment and order dated 18.03.2025 (annexure no.

1) passed by the Board of Revenue Uttarakhand Circuit Court Nainital in Second Appeal no. 74 of 2023-24 "Gurbaz Singh v. Maha Nand and others".

4. After arguing for a while, Mr. Atul Kumar Bansal, learned counsel for the petitioners submits that due to inadvertence proper relief could not be claimed in the Revenue Suit No. 22/01 of 2021-22, therefore, he may be permitted to withdraw the writ petition with liberty to move application in the pending application.

5. The writ petition is, therefore, dismissed as withdrawn, as prayed by learned counsel for the petitioner. The application, if filed by petitioner, shall be considered strictly as per merits and the liberty granted by this Court will not be construed as conferring any right or privilege in favour of the petitioner.
