Upon hearing the learned Counsel, the Court
made the following

JUDGMENT :

Heard learned counsel for the applicant and

learned Central Government Standing Counsel.

2. Learned counsel for the applicant would take

the Court through the General Conditions of Contract.

The respondent counsel would also concur with regard

to the existence of the dispute(s) and also existence of

the arbitration clause, and would submit that the

respondents have no objection for appointment of an

Arbitrator.

3. The submissions of both the counsels are

placed on record.

4. The instant Application is, accordingly,

disposed of by appointing Hon'ble Mr. Justice Vineet

2025:UHC:6036 Kothari, former Acting Chief Justice of High Court of

Madras and former Judge of the Rajasthan High Court

to officiate as an Arbitrator to adjudicate the disputes

that have arisen between the parties on merits, in

accordance with the Act.

5. Let a copy of this order be communicated to

Hon'ble Mr. Justice Vineet Kothari, former Acting Chief

Justice of High Court of Madras and former Judge of the

Rajasthan High Court, forthwith.

6. The Arbitrator shall, in terms of Section 11(8)

of the Act, furnish his disclosure in writing to the Court

within 15 days from the date of receipt of a certified

copy of this order. The Arbitrator shall, in consultation

with the parties, fix the remuneration and other

chargeable fees. The Arbitrator shall endeavour to hear

and pass an Award within the time provided under the

statute.

7. There shall be no order as to costs.

8. In sequel thereto, all pending Applications

stand disposed of.
