Mr. M.K. Ray, learned counsel for the revisionist.

2. Mr. S.S. Chauhan, learned Deputy Advocate General for the State.

3. The present revision is directed against the judgment and order dated 16.06.2025 passed by learned Judge, Family Court, District Almora in Misc. Criminal Case No.41 of 2023, Smt. Neeti Arya vs. Shri Ravi Kumar, whereby the application of the respondent no.2-wife for maintenance under Section 125 Cr.P.C. was partly granted and the revisionist-husband was directed to pay Rs.10,000/- per month as maintenance to the respondent no.2 from the date of filing of the application for maintenance.

It is contended by learned counsel for the revisionist that amount which has been fixed as maintenance is too heavy keeping in view the monthly income of the revisionist-husband which after deduction is Rs.27,375/- and he has burden of his mother and brothers. He further submits that respondent no.2 has left her matrimonial house alone leaving his 11 days old son after his birth.

6. Issue notice to the respondent no.2,

returnable within four weeks.

7. Steps to be taken within a week.

8. List on 29.08.2025.

9. In the meantime, the execution of the judgment and order 16.06.2025 passed by learned Judge, Family Court, District Almora in Misc. Criminal Case No.41 of 2023, Smt. Neeti Arya vs. Shri Ravi Kumar shall remain stayed, provided revisionist shall keep on paying Rs.8,000/- per month to the respondent no.2 on 10th of every month and shall also pay 50% of the arrears within three months from the date of passing of this order.

10. Stay application (IA No.1/2025) stands disposed of accordingly.
