Mr. Vinay Kumar, learned counsel for the Applicant.

2. The present application under Section 528 of BNSS has been filed on behalf of the Applicant - Raj Kumud Pathak S/o Daya Ram Pathak, against the Respondent - Deepak Sharma, challenging the judgment dated 06th June, 2025, passed in Criminal Case No.2367 of 2024, "Deepak Sharma Vs. Raj Kumud Pathak", pending before the court of learned Addl. Chief Judicial Magistrate, Kashipur, Udham Singh Nagar, be quashed.

3. Considering the submissions advanced by the learned counsel on behalf of the Applicant, an interference is being called for in the matter.

4. Admit.

5. Issue notice to the Respondent. Steps to be taken within a week. Three weeks' time is granted to the Respondents to file counter affidavit

6. Till the next date of listing, the effect and operation of the impugned judgment dated 06th June, 2025, passed in Criminal Case No.2367 of 2024, "Deepak Sharma Vs. Raj Kumud Pathak", pending before the court of learned Addl. Chief Judicial Magistrate, Kashipur, Udham Singh Nagar, shall remain stayed.

7. List this matter on 18th September, 2025.

8. Stay application (IA No.1 of 2025) stands disposed of accordingly.
