Mr. M.C. Pant, Advocate for the petitioners appeared through video conferencing. Mr. Virendra Kaparwan, Advocate for respondent nos.1, 3 and 4.

The services of the petitioner were reinstated in the year 1995. Now, petitioners claim some benefits uptil that date on the basis of a Government Order dated 15.02.2023 and/or based on a judgment of Hon'ble Allahabad High Court, Lucknow Bench ("the Court") of the year 1994. Now, there are two questions:- (i) If the petitioners raise their claims on the judgment of the year 1994 of the Court, is not the claim much belated after 30 years? (ii) As far as applicability of Government Order dated 15.02.2023 is concerned, it is applicable to those daily wagers, who were regularized on 23.12.2002 or date of their employment, whichever is later. The petitioners were never regularized. How is this Government Order applicable to them? This matter shall be heard on these two points.
