1. Mr. K.S. Bora, learned Deputy Advocate General for the State of Uttarakhand/appellant.
2. State has filed this appeal, against the acquittal of respondents, after delay of 1871 days. In para 5 of the affidavit filed in support of delay condonation application, however, it is mentioned that the permission to file appeal was granted by Office of Legal Remembrancer on 07.07.2020. The impugned judgment was rendered by 2nd Additional Sessions Judge, Dehradun on 13.02.2020. There is no plausible explanation for delay in filing the appeal.
3. From the statement made in the affidavit filed in support of delay condonation application, it appears that the concerned Officials have taken the matter very casually.
4. Secretary (Home) is directed to order an enquiry into the matter and fix responsibility for such an inordinate delay of 1871 days in filing this appeal.
5. List this case on 14.10.2025, on which date, Secretary (Home) shall file his personal affidavit indicating the progress in the matter.
